CARELESS BUS DRIVER HASTENS WOMAN’S DEATH

$700,000 SETTLEMENT

Barbara had been in a wheelchair most of her life due to several serious medical issues. But that didn’t stop her from leading a full life, which included working, traveling and getting out with her husband. Barbara and her husband(also in a wheelchair) used a specially outfitted municipal bus service to transport them on many of their trips. On Barbara’s last trip, she did some shopping at a local mall. Upon leaving the mall, the driver failed to properly secure Barbara’s wheelchair in place. He then drove at an excessive rate of speed and had to stop very suddenly for a red light. Barbara was ejected from her wheelchair and suffered a badly broken leg. After undergoing surgery at a nearby hospital, Barbara died. While her surgeon refused to tie Barbara’s death to the bus accident, Mark retained a renown medical expert to offer testimony that the broken leg was a contributing factor in her death.

BURNS FROM SPILLED COFFEE

$110,000 SETTLEMENT

Jan got her coffee every morning from drive-through at a local donut shop every morning. Then one morning a worker at the drive-thru window had trouble getting the window open. While holding the hot coffee, the worker pushed on the window, which suddenly burst open, causing the worker to lose her balance and spill hot coffee out the window and all over Jan’s chest. The coffee caused multiple small burns on Jan’s chest. The restaurant denied any issue with the window. Mark identified the company that maintained the windows and subpoenaed its records. The company had repeatedly been called out to address the non-functional window and had consistently recommended replacement. Despite minor medical bills, the defendant agreed to a substantial settlement due to the impact of the repair records.
